Terms of Service

These terms and conditions (this "Agreement") set out the legally binding terms of your participation in the PODpartner Affiliate Program (the "Program"). The Program is owned and operated by [PODpartner], ("PODpartner," "we," "us," or "our"). The Program is offered subject to your ("Affiliate," "User," or "you") acceptance, without modification, of all terms and conditions contained herein, together with all other operating rules, policies, and procedures that we may publish from time to time on [www.podpartner.com] (the "Site") — including, without limitation, our Terms of Service, Pricing, Shipping, After-sales Service Policy, and Privacy Policy, each of which is incorporated into this Agreement by reference. If you do not agree with this Agreement, do not use the Program.
You indicate your acceptance of this Agreement by completing the application process and continuing to participate in the Program.

1. Affiliate Eligibility

If you are an individual, you certify that you are at least 18 years of age. If you are a legal entity, you certify that you are an officer of, or are otherwise authorized to act on behalf of, that entity. You also certify that you are legally permitted to participate in the Program and take full responsibility for your use of it.
PODpartner may, at its sole discretion, limit or terminate access to or participation in the Program for certain individuals or entities — including, without limitation, ecommerce platforms, online marketplaces, competing print-on-demand or apparel-manufacturing providers, and other partners we determine to be ineligible. This Agreement is void where prohibited by law, and the right to access the Program is revoked in such jurisdictions.

2. Registration & Account

Joining the Program is free, with no follower-count or traffic minimum. The Program operates on your existing PODpartner account — no separate affiliate account is created. To participate, you submit the affiliate application from within your PODpartner account and provide all required information (including applicant name, primary country/region, promotion channels and public links, and acceptance of these Terms of Service and the PODpartner Privacy Policy). Your application is reviewed by our brand team; your affiliate status is activated only after approval, at which point you may access the affiliate dashboard and begin promoting. In the first phase, each user may submit only one application, and the application form is not re-openable after a decision.
By submitting your application, you agree to be bound by this Agreement, including its conduct rules. Your affiliate status and your right to earn commissions take effect only once your application is approved and your affiliate status is activated. You may never use another user's account without permission. You are solely responsible for all activity on your account and for keeping your credentials secure, and you must notify us immediately of any unauthorized use. PODpartner will not be liable for losses caused by unauthorized use of your account; you may be liable for losses incurred by PODpartner or others as a result of such use. You may cancel your participation at any time by closing your account.

3. Affiliate Link & Tracking

Once approved, you can create your referral links (collectively, the "Affiliate Link"). These consist of a main link (an account-level promotion link) and sub-links (content-level links used to distinguish specific videos, posts, articles, or campaigns). You may create up to 10 sub-links per day; creating your main link does not count toward this daily limit. You may place an Affiliate Link on your website, emails, blogs, videos, social channels, or similar campaigns from accounts or platforms registered in your name or that you are authorized to use.
When a prospective customer clicks your main link or a sub-link, a tracking cookie valid for ninety (90) days is stored in their browser. If a customer has clicked multiple Affiliate Links within the cookie's validity period, the most recent valid click governs (last-click attribution). A referral is credited to your affiliate account when the customer registers or places an order while your cookie is valid.

4. Commissions & Creator Incentives

4.1 Base commission

PODpartner will pay a base commission of seven percent (7%) of the eligible net merchandise value of every qualifying order placed by your referred customers — including their first order. The commission period for each referred customer runs for twelve (12) months, starting from the date that customer's first order is shipped. Orders placed after this 12-month period do not earn commission. There is no cap on total commission earned during the period.

4.2 Creator Incentives (milestone bonuses)

In addition to base commission, PODpartner offers Creator Incentives in the form of cumulative milestone bonuses across two tracks. Each milestone bonus is paid once, when your verified cumulative count first reaches that level. Only delivered orders count toward milestones — that is, orders whose commission has become Withdrawable. Unpaid, cancelled, or Pending orders do not count. Counts are measured cumulatively over the life of your affiliate account unless otherwise stated on the affiliate platform.

Creator Incentives are paid only after the qualifying milestone is verified. Counts exclude any orders that are cancelled before delivery, fraudulent, self-referred, or that we determine violate this Agreement. These incentives are discretionary and are not part of base commission. PODpartner may add, change, or withdraw incentive tracks, thresholds, and amounts at its sole discretion by posting updated terms on the affiliate platform; the schedule in effect at the time a milestone is reached governs that incentive.

4.3 Eligibility & calculation

  • A qualifying order is an order that is paid within the commission period and is not cancelled before delivery.
  • The commission period for each referred customer lasts twelve (12) months, starting from the shipment of that customer's first order. All qualifying orders that customer places within the 12-month period — including the first order and repeat purchases — earn commission.
  • Net merchandise value is the discounted price of the merchandise in an order. It excludes shipping, taxes, duties, and any other non-merchandise amounts. Product discounts and promotional codes are reflected in (deducted from) the merchandise value before commission is calculated.
  • Commissions and bonuses are not payable on: orders cancelled before delivery; self-referrals; fraudulent orders or orders we determine violate this Agreement; and any free-trial or no-charge sign-ups.
  • Records maintained by PODpartner and its affiliate-tracking platform are conclusive for all commission, bonus, and attribution determinations.

You can track your commissions by logging into your Affiliate Dashboard. You are solely responsible for reporting and paying any taxes on your earnings from the Program; PODpartner does not withhold or remit taxes on your behalf, will not require tax documentation from you, and cannot provide tax advice.

5. Payment

Each commission moves through three states:

  • Pending — the order has been paid but not yet delivered. The commission is credited to your account but is not yet available to withdraw.
  • Withdrawable — the order has been delivered. The commission is available to withdraw.
  • Cancelled — the order was cancelled in full before delivery. The corresponding commission is cancelled and is excluded from your balance and statistics.

While a commission is Pending, it still tracks the order:

  • if part of the order is cancelled, the commission is automatically updated and the cancelled items are deducted;
  • if the whole order is cancelled, the commission becomes zero and moves to Cancelled.

Once a commission becomes Withdrawable, it is final. Order operations that happen afterwards — including cancellation, reshipment, or replacement — do not affect it. PODpartner will not reverse a Withdrawable commission except in cases of fraud, abuse, or other violation of this Agreement (see Section 10).

  • Minimum withdrawal amount: USD $20. A withdrawal request must be at least $20 and may not exceed your withdrawable balance.
  • The current version supports PayPal only. PayPal may charge a processing fee, and funds typically arrive within 1–3 business days. You must provide a valid PayPal receiving account.
  • Withdraw whenever your withdrawable balance reaches the minimum — there is no fixed monthly payout cycle and no cap on earnings. Only one withdrawal request may be in progress at a time; you cannot submit a new request while another is pending.
  • If this Agreement is terminated before your first commission is due and your balance is below the minimum, no commission will be payable.

6. Restrictions

You may use the Affiliate Link solely to promote PODpartner and refer prospective customers to the Site. Except where permitted by applicable law, you shall not:

  1. Send unsolicited commercial email ("spam") or use any unlawful advertising method; all marketing must comply with applicable laws and regulations (including the U.S. CAN-SPAM Act, the FTC's endorsement and disclosure guidelines, GDPR, and equivalent EU/UK rules).
  2. Display the Affiliate Link in any way that disparages PODpartner or creates a derogatory, misleading, or negative impression of it.
  3. Make false or misleading representations about PODpartner, its products, pricing, or capabilities.
  4. Associate the Affiliate Link with content that is illegal, vulgar, hateful, sexually explicit, defamatory, or that infringes any third party's intellectual property, privacy, or other rights.
  5. Bid on or use PODpartner brand terms in paid search — including "PODpartner," "POD partner," "podpartner.com," or any variation, misspelling, or confusingly similar term — or direct-link paid traffic (PPC/PPV/media buys) without first routing it through your own landing page or web property.
  6. Register or use domain names, social handles, or app names containing any PODpartner trademark or a confusingly similar variation.
  7. Engage in self-referrals, cookie stuffing, click/pixel stuffing, clickjacking, linkjacking, typosquatting, domain spoofing, or traffic sourced from pay-to-click, auto-surf, banner/click exchanges, pop-ups/unders, or similar low-quality methods.
  8. Promote PODpartner on unauthorized coupon, deal, or cashback sites without prior written approval.

Disclosure of your affiliate relationship. We recommend that any content including your Affiliate Link clearly and conspicuously discloses your affiliate or paid relationship with PODpartner (for example, "#ad", "affiliate link", or "paid partnership"), consistent with the FTC Endorsement Guides and equivalent local rules. Meeting the disclosure requirements that apply to you is your responsibility.
You further represent that your participation in the Program and your promotional activities comply with all applicable laws and regulations in your jurisdiction.

7. Advertising & Brand Use

You are solely responsible for complying with all applicable advertising laws and platform policies (Google, Meta, Bing, TikTok, and others), including any future updates. Where a platform's guidelines and this Agreement conflict, this Agreement controls.
PODpartner's name, logos, and trademarks may be used only in the form and per the specifications we supply; they may not be altered, modified, or combined with other marks. You must remove any advertising, video, or content that we deem offensive or non-compliant within 24 hours of notice. You may engage in legitimate SEO and PPC activity within the restrictions in Section 6.

8. Customer Information

Each customer who reaches the Site through your Affiliate Link provides their information directly to PODpartner. All such customer information is the sole and exclusive property of PODpartner and the respective customer. You have no right to participate in the order process or to receive any customer's personal information, and PODpartner will not disclose personally identifying information about customers to you. You may collect personal information directly in connection with your own activities, but you may not forward customer data to PODpartner outside the Program's normal operation.

9. Independent Contractor

Nothing in this Agreement creates any agency, partnership, joint venture, franchise, or employment relationship. You act as an independent contractor: you control your own schedule and methods, bear your own business expenses, may engage assistants, and may have other clients. You will receive commissions only for referrals made in accordance with this Agreement.

10. Term & Termination

This Agreement is effective when PODpartner accepts your application (in writing or electronically). Either party may terminate at any time, with or without cause. Upon termination for any reason, all licenses granted under this Agreement immediately end, and you must promptly cease all use of, and remove all links to, the Site and all PODpartner trademarks, logos, and materials.
If you breach any applicable law or this Agreement, PODpartner may suspend or terminate your participation and your account. Orders that have not been delivered do not generate commission. In cases of fraud or deliberate abuse, PODpartner may cancel the commissions arising from that conduct.

11. Release

You release PODpartner and its officers, directors, agents, subsidiaries, joint ventures, and employees from all claims, demands, and damages (actual and consequential), known and unknown, arising out of or connected with any dispute relating to the Program or this Agreement, including any failure to realize anticipated benefits of the collaboration.

12. Trademarks

If you reference any PODpartner trademark, you must attribute it to PODpartner. You must not use any PODpartner trademark (i) as the whole or part of your own marks; (ii) in connection with non-PODpartner activities, products, or services; (iii) in a confusing, misleading, or deceptive manner; or (iv) in a way that disparages PODpartner or its products, services, or the Site.

13. Indemnity

You will indemnify and hold PODpartner (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys' fees, arising out of your breach of this Agreement or your violation of any law or third-party right.

14. Limitation of Liability

PODpartner will not be liable for any indirect, special, incidental, or consequential damages (including lost revenue, profits, or data) arising in connection with this Agreement, even if advised of the possibility of such damages. PODpartner's aggregate liability under this Agreement will not exceed the total commissions paid or payable to you hereunder. PODpartner makes no express or implied warranties regarding the Program, this Agreement, or any products or services, and does not warrant that the Site will be uninterrupted or error-free.

15. Governing Law

This Agreement is governed by and construed in accordance with the laws of the People's Republic of China (for the purpose of this Agreement, excluding Hong Kong, Macau, and Taiwan), without regard to conflict-of-laws principles. This Agreement is interpreted in the English language regardless of any translation.

16. Dispute Resolution

The parties shall first attempt to resolve any dispute arising out of or relating to this Agreement through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to [the China International Economic and Trade Arbitration Commission (CIETAC)] for arbitration in accordance with its rules then in effect. The seat of arbitration shall be [Shenzhen / the city of PODpartner's registration], the language of arbitration shall be English, and the arbitral award shall be final and binding on both parties.

17. General

No waiver of any breach is a waiver of any subsequent breach. If any provision is held invalid or unenforceable, it will be struck and the remaining provisions enforced. PODpartner may assign this Agreement upon notice to you. Headings are for reference only. You waive any right to require an original (non-electronic) signature. PODpartner does not guarantee that it will act against every breach of this Agreement.
Changes to this Agreement. PODpartner may, at its discretion, change, modify, suspend, or discontinue this Agreement, the Program, commission rates, attribution rules, fees, or terms at any time by posting updated terms on the Site or affiliate platform. You are responsible for reviewing such changes, and your continued participation in the Program constitutes acceptance of the modified terms.
